Rawls, Spitzer, and Capital Gains Taxes

Eliot Spitzer makes the argument for treating capital gains as ordinary income. I’m not sure a libertarian would buy his argument that treating capital gains and ordinary income the same is akin to a flat tax. He does, however, link to some evidence that raising the capital gains tax would have little to no effect on the growth rate.
